Estate Settlement
When a loved one passes away it is most certainly a stressful and emotional time. It is our goal to assist families with the Probate process in the most efficient way possible, ensuring all of the assets are passed in the intended manner. We are also experienced in handling more complex Trust Administrations, including the preparation of federal Estate Tax Returns, as well as Rhode Island and Massachusetts Estate Tax Returns. We will help to ensure that the Executor or Trustee of the Estate or Trust is aware of his or her obligations and we can provide as much or as little assistance in the process as is necessary.
Guardianships
A Guardianship is sometimes necessary when an individual is not able, or no longer able, to make decisions for himself or herself. It is a process through the Probate Court whereby a party petitions the Court to be appointed Guardian, which requires demonstration of the proposed ward’s incapacity to the Probate Court’s satisfaction, and after such appointment, the Guardian will be required to account to the Court for the ward’s finances during the ward’s lifetime. A Guardianship is most common in situations where parents have a child with special needs who attains the age of majority (18), or when an adult parent is no longer able to make decisions for himself or herself and does not have a power of attorney in place.
